Terms, safety rules, and user notice for Chipmunks Dance AI.

1. Service operator and agreement

These Terms apply to Chipmunks Dance AI at chipmunksdanceai.live, operated by Cherry, an independent developer ("we," "us," or the "Service"). By using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy. The Service provides digital AI-generated video and related account, credit, and subscription features. It does not ship physical goods or provide live human services.

Important user notice

  • You must be 18 or older to use the Service.
  • Do not upload a photo or other reference material depicting anyone under 18, even if the image is non-sexual or you are the person's parent or guardian.
  • Upload only material you own or have permission to use. Get prior consent from every adult shown in a photo before submitting it.
  • AI-generated results can be inaccurate, unexpected, or similar to other results. Review each result before sharing or using it.
  • Subscriptions renew automatically until canceled. Review the price, billing interval, and credit terms at checkout. See our Refund Policy for cancellation and refund details.
  • Our Privacy Policy explains how we process uploaded photos, generation data, account information, and payment information.

2. Eligibility and accounts

You must be 18 or older to use the Service. You are responsible for your account credentials and all activity under your account. Provide accurate account information and contact us promptly if you suspect unauthorized access.

3. AI models and generated content

The Service lets you create short vertical dance videos from eligible photos, templates, and generation settings. Features, templates, output options, and the AI models used may change as the Service develops. AI-generated results may be inaccurate, unexpected, unsuitable for your purpose, or similar to other results. We do not promise that a result is unique or free of third-party rights. Review each result and make sure your use of it is lawful.

You retain the rights you hold in your input materials and, to the extent applicable, your generated results. You grant us permission to host, copy, transmit, and technically process those materials only as needed to provide, secure, and support the Service. We do not claim ownership of your content.

Where required by law, the Service will add a visible notice to generated media and machine-readable metadata to generated files identifying them as AI-generated. The exact presentation may vary by template and file format. Do not remove, conceal, or alter these labels or metadata. When sharing or publishing generated media, follow any disclosure requirements that apply to you.

4. Acceptable use and content safety

You may upload or generate content only if you have the necessary rights and permissions. Do not upload a person's image, voice, or other identifying material without that adult's prior consent. Do not use the Service to impersonate or mislead others, or to create content that violates privacy, publicity, intellectual-property, or other third-party rights.

We have zero tolerance for child sexual abuse material (CSAM), child sexual exploitation, or sexualized depictions of minors. You may not upload any photo or other reference material depicting a person under 18.

You may not use the Service to create, request, upload, or distribute:

  1. Pornographic, sexually explicit, or other NSFW content.
  2. Graphic violence, gore, or content that glorifies real-world harm.
  3. Hate speech or content that promotes discrimination or violence against a protected group.
  4. CSAM, sexualized depictions of minors, or content that exploits or endangers a minor.
  5. Non-consensual intimate imagery, non-consensual deepfakes, or deceptive impersonations of a real person.
  6. Content that infringes copyright, trademark, publicity, privacy, or other third-party rights.
  7. Content that violates applicable law or is intended to facilitate fraud, harassment, or abuse.

We may use automated or human-assisted safety checks to detect prohibited content and misuse. Automated checks can produce false positives or false negatives and do not guarantee that every prohibited item will be identified.

To report content or suspected misuse, email support@chipmunksdanceai.live with a description and, if available, the task ID. We aim to acknowledge reports within 1 business day and complete an initial review within 5 business days. If a case needs more time, we will explain why and provide an updated timeframe. Reports involving urgent risks, including risks to minors or credible threats of physical harm, are prioritized. We may hide reported content or restrict access while reviewing it. Depending on our findings, we may remove content, suspend or terminate accounts, or take other steps required by law. Repeated or serious violations may result in loss of access to purchased credits where permitted by law.

5. Prices, credits, subscriptions, and payment

The checkout page shows the price, currency, credit amount, and billing interval before you pay. One-time purchases do not renew. Recurring subscriptions renew at the interval and price shown at checkout until canceled. By starting a subscription, you authorize recurring charges to the payment method shown at checkout.

You can cancel a subscription from your account's Settings → Billing page or through the payment provider's customer portal. Cancellation stops future renewals once effective; paid access continues through the current billing period. Credits expire according to the terms shown for the product or plan. Failed generation tasks return credits as described on the pricing or checkout page.

Refunds: You may request a refund for a one-time credit purchase within 7 days if none of its credits have been used. For an initial subscription charge, you may request a refund within 7 days if none of the credits for that billing period have been used. Renewal charges are generally not refundable except for duplicate charges, a verified Service outage lasting more than 72 consecutive hours (pro-rated for the affected period), or where required by law. Nothing in these Terms limits mandatory consumer rights. See our Refund Policy for request instructions and processing details.

Payments are processed by third-party payment providers. They handle checkout and payment credentials; we receive the transaction information needed to deliver purchases, but do not receive or store your full card number or security code.

6. Service changes and account action

We may update or discontinue features as the Service evolves. We may restrict or terminate access to address a violation of these Terms, security risks, abuse, or legal requirements. Where appropriate and legally permitted, we will provide notice. You may stop using the Service at any time.

7. Disclaimers and liability

The Service is provided on an "as available" basis. We do not exclude warranties, liabilities, or consumer rights that applicable law does not allow us to exclude. To the extent permitted by law, we are not responsible for indirect or consequential losses resulting from your use of the Service.

8. Governing law and jurisdiction

To the extent permitted by applicable conflict-of-law rules, these Terms are governed by the laws of the People's Republic of China as applied in mainland China. You and we submit to the non-exclusive jurisdiction of the competent courts in Shenzhen, mainland China. This does not limit any mandatory consumer-protection rights or courts available to you under the law of your habitual residence.

9. Changes and contact

We may revise these Terms and will post the current version here with its effective date. Material changes will be communicated through the Service or another reasonable channel where required by law.
